Big Settlement in Dram Shop Case

A mutimillion dollar settlement was reached in a wrongful death case against a Sunset Hills Police officer and O'Leary's in South St. Louis County. The office was intoxicated and what is significant is that the bar contributed to the settlement as showing some responsibility for the deaths. The plaintiff's have an extremely high burden of proof int these types of cases in that they have to show by clear and convincing evidence that the bar knew or should have know of the patron's intoxication and it either continued to serve alcohol or let her leave and drive when it knew or should have known that she was drunk at the time.
