Who can bring a wrongful death claim?
A: Wrongful death is a creature of statute. There are three classes of beneficiaries in Missouri. Class one includes the spouse, children and parents of the person who died who is referred to as the decedent. If there are no class one beneficiaries, then you go to class two and class three. Class two beneficiers would be the brother or sister of the decedent or the decendents of the the brother and sister. Class three includes anybody who can prove damages who would be appointed by the court as a plaintiff ad litem.
