I fell and was hurt on a city street. Do I have a time period besides the statute of limitations to give notice?

 

A: Most cites have a notice requirement that requires the injured claimant or his representative to give notice to the city manager or mayor of:  1. the fall; 2. the date of the fall; 3. the defective condition of the property; 4. the type of injury received; and 5. that the claimant will make a claim for the injury.

You generally have 90 days from the date of the injury to give this type of notice.  It should be by certified mail, return receipt requested.  Failure to give notice is fatal to your case despite a general 5 year statute of limitations.
