Negligent Entrustment Case Settles For Policy Limits


This case was a bit unusual.  The defendant owned a car.  He had a mentally deranged step son who had taken the family car before.  On this particular occasion, the step son took the car after setting his step father on fire!  The step son then proceeded to drive across the state and kill my clients' son who was a police office.   The deceased had set up a road block to stop the car thief.  The step son was considered an uninsured driver so that the car insurance wouldn't attach so I sued for negligent entrustment where the defendant (step father)  knew or should have known to keep the keys away from the step son.  The case was settled for policy limits for the negligent entrustment, policy limits for a death arising out of a wreck with an uninsured driver and an additional $250,000 for the family for the death of the officer killed in the line of duty through the department of justice.  This was the most money that could have been recovered in this sad case.
