Missouri Supreme Court Rules on Constitutionality of Tort Reform

Damage caps cannot apply to cases that arose before the law changed in August 2005.   So says the Missouri Supreme Court.  In a 5 judge ruling, not assigned to any judge in particular, the court allows for another day to determine if the caps on non economic damages are constitutional.  Some feel that the caps usurp the function of the jury and others feel that the caps discriminate against poor people since there are no caps on economic damages.   Call St. Louis Accident lawyer Alvin Wolff if you have any questions about the decision.
